The programs are designed to assist customers in the implementation of projects that reduce natural gas use. Prescriptive rebates are available for customers replacing less-efficient equipment on a one-for-one basis with predefined energy-saving technologies. Custom rebates are available for more complex projects or those that incorporate alternative technologies. Pre-approval is required for many projects within the programs. Please refer to specific program applications for details or contact your program team. This agreement, upon approval, allows the applicant to participate as a registered trade ally in the Companies’ Energy Efficiency Programs.Terms and Conditions for Participation(Required) I have read and agree to the terms and conditions set forth in this agreement. I understand that any violations deemed harmful to program success can result in corrective action or removal from the programs.1. Applicant agrees to actively promote the Companies’ Energy Efficiency Programs described on individual program applications. 2. Applicant agrees to comply with any published program guidelines. 3. The Companies may include applicant’s name as a Registered Trade Ally in the programs. 4. Participation does not constitute an endorsement of the applicant by the Companies, and the applicant shall not represent to customers that the Companies’ Energy Efficiency Programs or the Companies endorse its business. Applicant may not use the Companies’ names or logos or the program name, the Peoples Gas and North Shore Gas Energy Efficiency Programs, in any advertising or promotional literature or material of the applicant’s business. 5. Applicant agrees to report any proposed custom projects to the Companies’ program administrator. 6. Applicant agrees to abide by all applicable laws, building codes and federal, state and local licensing and permitting requirements. 7. Participation is valid for the duration of the programs unless terminated at the sole discretion of the Companies. 8. The Companies reserve the right to discontinue or change any program at any time. 9. The Companies do not endorse any particular manufacturer, product or system design within these programs. 10. The Companies will not be responsible for any tax liability imposed on the customer or trade ally as a result of the payment of rebates. 11. The Companies do not expressly or implicitly warrant the performance of trade ally or installed equipment. 12. The Companies are not responsible for the disposal or recycling of any waste generated as a result of any project. Trade ally shall be responsible for disposal or recycling of any waste generated as a result of any project. 13. The acceptance of program agreements is determined solely by the Companies. 14. The Companies are not liable for any damage caused by the installation of equipment, nor for any damage caused by the malfunction of installed equipment. 15. Trade ally shall indemnify Companies and its parent, affiliates, subsidiaries, employees and agents against any third party claims or liability whatsoever, related to the acts or omissions of trade ally. Rebates will only be rewarded for prescriptive or custom projects providing natural gas savings. Projects that have or will receive funding from other energy efficiency programs available to Illinois businesses will be reviewed on a case-by-case basis for potential partial funding from the Companies. Rebates are not retroactive for measures installed prior to program implementation. Any custom project must receive written approval BEFORE project installation. Specific eligibility requirements may apply for each individual program. All project eligibility determinations are at the sole discretion of the Companies. The Companies accept no liability for eligibility determinations. Program offerings are subject to change without notice.
